Distance Sales Agreement

Effective Date: September 15, 2026

This Distance Sales Agreement (“Agreement”) is concluded electronically between the parties identified below in connection with the purchase of online courses, mini-courses, digital educational content, live training sessions, workshops, events, individual and group NeuroGraphica coaching sessions, and other related services offered through chernikart.com by Chernik Art.

1. Parties

Hereinafter referred to as “Chernik Art”, the “Seller”, or the “Service Provider”.

1.2. Buyer / Consumer

The Buyer's name, surname, address, email address, telephone number, and other information required to process the order are based on the information provided electronically by the Buyer during checkout.

Hereinafter referred to as the “Buyer” or the “Consumer”.

2. Subject of the Agreement

The purpose of this Agreement is to determine the rights and obligations of the parties regarding the sale and performance of online courses, mini-courses, digital content, live training sessions, workshops, events, individual or group NeuroGraphica coaching sessions, and other services ordered electronically by the Buyer through chernikart.com.

The type, content, main characteristics, price, currency, applicable taxes, payment terms, delivery or access method, and other relevant details of the purchased product or service are displayed to the Buyer before the order is completed on the relevant product or service page and/or at checkout.

3. Main Characteristics of Products and Services

Chernik Art may offer the following products and services:

  • Online training programs and courses
  • Mini-courses
  • Pre-recorded video lessons
  • Digital educational materials
  • PDFs, worksheets, and other digital content
  • Live online training sessions and workshops
  • In-person workshops and events
  • Individual NeuroGraphica coaching sessions
  • Group NeuroGraphica coaching sessions
  • Other related educational and creative development services

The scope, duration, content, access method, and any special conditions applicable to each product or service are stated separately on the relevant sales page.

4. Pre-Contract Information and Formation of the Agreement

Before becoming bound by a payment obligation, the Buyer is provided with information regarding the main characteristics of the relevant product or service and the essential conditions of the purchase.

Before completing the order, the Buyer is informed about matters including:

  • The main characteristics of the product or service
  • Seller / Service Provider information
  • The total purchase price and applicable taxes
  • Any additional charges, where applicable
  • Payment conditions
  • Delivery, performance, and digital content access conditions
  • The right of withdrawal and any applicable statutory exceptions
  • Cancellation and refund conditions

Once the Buyer confirms the relevant pre-contract information electronically and completes the order in a manner that creates a payment obligation, this Agreement is considered concluded electronically.

Processing of the order may be subject to successful payment or confirmation of the transaction by the authorized payment service provider.

5. Price and Payment

The sales price of each product or service is displayed on the relevant product or service page.

Before payment is completed, the Buyer is shown the total amount payable, including applicable taxes and any mandatory charges.

Payment may be made using bank cards, credit cards, or other electronic payment methods available on the website.

Payments may be processed by authorized third-party payment service providers. Chernik Art does not store full debit or credit card details within its own systems.

Products and services may be displayed or charged in Turkish Lira or other available currencies. The applicable transaction currency and final amount to be charged are displayed before payment is completed.

Exchange rates, foreign transaction fees, currency conversion charges, or other fees imposed by the card-issuing bank or financial institution are subject to that institution's terms and are outside Chernik Art's control.

6. Delivery and Access to Digital Content

Online courses, mini-courses, and other digital content are not physically shipped.

Unless otherwise stated on the relevant product page, access is provided following successful payment and completion of any required verification procedures.

Access may be provided through one or more of the following methods:

  • A Chernik Art user account
  • An online learning platform
  • An access link sent by email
  • The order confirmation page
  • Another electronic method specified for the relevant service

Digital content is considered delivered when electronic access to the relevant content has been made available to the Buyer or when the necessary access information has been provided.

Access may occasionally be delayed due to technical, security, bank, or payment-provider verification.

7. Live Training, Workshops, Events and Coaching Sessions

Where the Buyer purchases live online training, an in-person workshop, an event, or an individual or group NeuroGraphica coaching session, the applicable date, time, location, or online participation information will be stated on the relevant page or communicated following the purchase.

For services scheduled for a specific date or time, the Buyer is responsible for reviewing the relevant date, time, and participation requirements before completing the purchase.

If Chernik Art fully cancels an event or session, the Buyer may be offered a suitable alternative date or receive a refund for the affected service.

If Chernik Art materially changes the date of an event or session and the Buyer does not accept the new date, the amount relating to the unprovided service will be handled in accordance with applicable law and the Refund Policy .

8. Right of Withdrawal

Where applicable consumer protection legislation provides a right of withdrawal for a distance service contract, the Consumer may generally exercise that right within 14 days from the date the Agreement is concluded, without providing a reason and without paying a penalty.

A withdrawal notice may be submitted in writing to info@chernikart.com.

To enable identification of the relevant order, the following information is recommended:

  • Full name
  • Email address used for the purchase
  • Order number, if available
  • Purchased product or service
  • Date of purchase

Where a statutory right of withdrawal applies, the Consumer is not required to provide a reason for exercising that right.

8.1. Digital Content and Immediate Access

Statutory exceptions to the right of withdrawal may apply to services performed immediately in an electronic environment and to intangible digital content supplied immediately to the Buyer.

Where the Buyer requests access to digital content before the expiry of the applicable withdrawal period, the Buyer will be informed of the relevant consequences and, where required, the necessary explicit request or consent will be obtained.

Where digital content is made available immediately following purchase, any applicable statutory exception to the right of withdrawal will be communicated before the relevant transaction is completed.

8.2. Services Beginning Before the Withdrawal Period Ends

Where training, a coaching session, or another service begins before the expiry of the applicable withdrawal period at the Buyer's request or, where required, with the Buyer's express consent, the relevant statutory provisions and exceptions concerning the right of withdrawal will apply.

The Consumer's mandatory statutory rights remain unaffected.

9. Refunds

Where a withdrawal or refund request is accepted under applicable law or the Chernik Art Refund Policy, the refund will, where reasonably possible, be made using the payment method originally used for the purchase.

Where a statutory right of withdrawal has been validly exercised, amounts required to be refunded will be returned within the period prescribed by applicable law.

In applicable cases, the refund will be processed no later than 14 days from receipt of a valid withdrawal notice.

After the refund has been submitted to the relevant bank or payment provider, the time required for the amount to appear on the Buyer's card or account may depend on the bank, card network, and payment service provider.

Duplicate or incorrect charges will be investigated and refunded where confirmed.

10. Technical Access Problems

If the Buyer is unable to access purchased digital content because of a technical issue caused by Chernik Art, the Buyer should contact info@chernikart.com.

Chernik Art will take reasonable steps to resolve the issue, restore access, or provide an appropriate alternative solution.

A temporary technical issue that can reasonably be resolved within an appropriate period does not automatically create a right to a refund.

If a technical issue caused by Chernik Art cannot be resolved within a reasonable period and the relevant service cannot be provided, the matter will be assessed under applicable law and the Refund Policy.

11. Usage Rights and Intellectual Property

Online courses, videos, drawings, PDFs, worksheets, texts, images, and other digital materials provided by Chernik Art are intended solely for the personal use of the purchaser.

The Buyer may not:

  • Share account or login details with third parties
  • Record, copy, or reproduce training videos without authorization
  • Distribute or resell digital content to third parties
  • Publish content online or on social media without permission
  • Use Chernik Art materials without authorization to create commercial training programs, courses, or similar products

A purchase does not transfer any intellectual property rights to the Buyer.

12. Educational Purpose

Chernik Art courses, workshops, individual and group NeuroGraphica coaching sessions, and other materials are provided for educational, creative, and personal development purposes.

The services do not constitute medical or psychological diagnosis, treatment, or psychotherapy and do not replace professional medical, psychological, legal, or financial advice.

Individual experiences and results may vary.

13. Personal Data

The Buyer's personal data is processed in accordance with the Chernik Art Privacy Policy and applicable data protection legislation.

Information necessary to process or verify a payment, ensure transaction security, or comply with legal obligations may be shared with the relevant bank, payment institution, or other service provider to the extent reasonably necessary.

14. Force Majeure

Neither party will be liable for temporary failure to perform obligations under this Agreement to the extent such failure results from circumstances beyond that party's reasonable control, including natural disasters, fire, war, epidemics, internet or infrastructure outages, decisions of public authorities, and similar events.

Where force majeure permanently prevents the provision of the relevant service, the Consumer's statutory refund and other mandatory rights remain unaffected.

15. Related Policies and Documents

This Agreement should be read together with the following policies and terms:

Where any provision of these documents conflicts with a mandatory consumer right, the applicable mandatory legal provision will prevail.

16. Complaints and Dispute Resolution

The Buyer may submit requests or complaints regarding purchased products or services using the following contact details:

Consumer disputes may be submitted to the competent Consumer Arbitration Committees (Tüketici Hakem Heyetleri) and Consumer Courts (Tüketici Mahkemeleri) in accordance with applicable legislation of the Republic of Türkiye.

17. Entry into Force

Before the order is completed, the Buyer is provided with an opportunity to review this Agreement and the required pre-contract information relating to the purchase.

This Agreement enters into force between the parties once the Buyer provides the required electronic confirmations and the order is created electronically.

The Consumer's mandatory statutory rights remain unaffected.
